FUNCTIONS AT NEW GUERNICA

TERMS & CONDITIONS

1. BOOKING CONFIRMATION

A booking is confirmed when a non-refundable deposit is paid. The non-refundable deposit will be negotiated between you and the venue. By paying the non-refundable deposit, you agree to be bound by these terms and conditions outlined herein. The terms and conditions are also located on the venue’s website.

2. MINIMUM NUMBER OF GUESTS

Minimum number of guests must be provided to the venue seven days prior to your function. You will be charged for the minimum number of guests provided by you, regardless of number turnout. You will incur an additional fee if the number of guests exceed the minimum number of guests provided by you.

3. MINIMUM SPEND

The minimum spend is dependent on package, space, and time and is outlined in the functions package. If you purchase additional drinks on the night of your function, you must pay for the additional drinks on the night.

4. PAYMENT METHODS AND FEES

Payment is accepted by cash, Visa, MasterCard and Amex. Payment by card incurs an additional fee of 1% for debit cards, 1.5% for credit cards, and 2% for AMEX in accordance with the Australian Competition and Consumer affairs guidelines https://www.accc.gov.au/consumers/prices-surcharges-receipts/credit-debit-prepaid-card-surcharges. We also accept payment by direct debit (remittance evidence required) or bank cheque, but we do not accept company or personal cheques.

5. CANCELLATION FEE

You will forfeit your deposit if you cancel your function. No additional cancellation fee will be incurred by you.

6. PERSONAL DRINKS AND FOOD

You must not bring into the venue alcoholic or non-alcoholic beverages or your own home cooked food for food safety reasons. Food from a third-party catering business may be brought into the venue by the third party. The third party will be solely responsible for the food, which shall be maintained under a strict food safety program administered by the Victorian Department of Health https://www2.health.vic.gov.au/public-health/food-safety/food-businesses/food-safety-program

7. PERSONAL DECORATIONS

You must give the venue seven days’ notice of your intention to use personal decorations. Approval by the venue is required before dressing the venue with personal decorations. Confetti or table scatterings are not permitted.

8. DJs/PHOTOGRAPHERS

You must give the venue seven days’ notice of your intention to use personal entertainment. Approval by the venue is required before engaging entertainers. The venue may assist you in sourcing a disk jockey or a photography at an additional fee negotiated between you and the venue.

9. GUESTS

All guests must be over 18 years of age and provide a driver’s licence, passport, or proof of age card unless accompanied by a parent. The venue will serve alcohol responsibly in accordance with the Liquor Control Reform Act 1998 (Vic) https://www.vcglr.vic.gov.au/liquor/restaurant-cafe/understand-your-liquor-licence/legislation-and-regulations Consumption of alcohol is limited to guests over 18 years of age. Guests that display anti-social behaviour or signs of intoxication will be evicted by venue staff. The venue is private property and the venue reserves the right to refuse entry or remove any person from the venue to protect the safety of guests and the venue.

10. SET UP / BREAK DOWN

You may set up 2 hours before the starting time of your function and you must remove your personal items within 2 hours after the finishing time of your function unless a longer period is approved by the venue. Storage of personal items is at the discretion of the venue. The venue will not be responsible for loss or damage of personal property stored at the venue.

11. CLEANING FEE

A reasonable additional cleaning fee may be charged at the discretion of the venue. A reasonable additional cleaning fee will be applied if extraordinary mess, or damage was incurred by the venue.

12. YOUR LIABILITY

You accept responsibility to make good any financial damage caused to the venue by you or your guests during your function. The venue will not be responsible for loss or damage to personal property in the venue.

TERMS & CONDITIONS

Definitions

1.     The Company refers to Famous Four Pty Ltd (ACN 098 287 9717)
2.     The Business refers to New Guernica, 64-68 Smith Street, Collingwood, 3066.
3.     Patron refers to any person who enters the premises of New Guernica.

Entry

1.     The Company reserves the right to refuse entry to patrons displaying anti-social behaviour, signs of intoxication, or nearing intoxication.
2.     The Company reserves the right to evict a patron for anti-social behaviour, nearing intoxication, or intoxication.

Drinks

1.     The Company reserves the right to refuse the service of alcohol to anti-social, near intoxicated or intoxicated patrons.
2.     The Business applies responsible service of alcohol at all times.
3.     Rapid consumption of alcohol is not permitted.
4.     Free drinking water will be available at the bar at all times.
5.     2-4-1 drinks are limited to basic spirits, house beer, and house wines from 5 pm until 10 pm every Friday.
6.     A total of 2 drinks may be purchased over the bar at one time by a patron.

Food

1.     Pizza by Ladro Pizza may be purchased using a QR code on tables, at the bar, and online.
2.     Pizza quality and pizza delivery times will vary.
3.     The Company has no control over the pizza's quality and delivery times.
4.     The Company is not liable for poor quality pizzas, delays in the delivery of pizzas, or injury caused by pizzas.
5.     Packaged bar snacks, such as nuts and chips, will be available over the bar.
6.     The Company is not liable for poor quality nuts and chips or injury caused by the nuts and chips.

Bookings

1.     Table bookings must be arranged online.
2.     No cancellation fee will apply to a table cancellation, but cancellation must be made online before the day of the booking.
3.     A table booking of 10 patrons will be gifted a complimentary bottle of sparkling after the arrival of the 10th guest.

Specials

1.     Occasionally, guests will be offered a drink special beyond the standard 2-4-1 drinks.
2.     Extraordinary offers will be provided to subscribers via physical drink cards or online.
